Do You Know the Difference Between These Two Documents

These two documents sound the same, but they are completely different legal documents that serve separate purposes.

A Living Will describes your medical wishes if you're unable to express them on your own.

A Living Trust is used to transfer property to loved ones outside of the Probate Court system with real estate being the most widely transferred property that can remain entangled in Probate Court.

The Will is a document that prescribes in general terms how you want your property distributed but almost always must go through the Probate Court to be validated, approved and overseen so most times it is very costly and consumes time.
